Acceptable Use & Refund Policy

Your access to and use of any Mixar offerings are contingent upon your compliance with the rules set forth in this "Acceptable Use Policy", which Mixar may update from time to time, and the Refund Policy below, which explains how refunds and cancellations work. Both are part of, and incorporated into, our Terms of Service. Capitalized terms have the meanings given in the Terms of Service.
1. Prohibited content
You must not use the Service to create, upload, generate or distribute content that:
a. Is unlawful, defamatory, or incites violence;
b. Infringes the intellectual property, privacy, publicity, or other proprietary rights of any third party (including copyright, trademark, design rights, or trade secrets), without the express prior written consent of the applicable rights holder;
c. Is threatening, abusive, harassing, degrading, hateful, or intimidating, or otherwise fails to respect the rights and dignity of others;
d. Is obscene, indecent, pornographic, or otherwise objectionable - this is prohibited without exception;
e. Is sexually explicit material involving minors, or any content that sexualizes, exploits, or otherwise endangers children - this is prohibited without exception;
f. Depicts a real, identifiable individual in a misleading or harmful way, including non-consensual deepfakes or other synthetic content presented as authentic;
g. Constitutes a national or state secret, classified information, controlled unclassified information, export-controlled information, or other material subject to official confidentiality obligations;
h. Contains passwords, access credentials, cryptographic keys, or other secret authentication information belonging to another party;
i. Is or contains malware, including any virus, worm, Trojan horse, time bomb, spyware, or other code or program that is harmful, invasive, or designed to damage, hijack, limit the use of, or covertly monitor any hardware, software, or equipment; or
j. Is designed to deceive, defraud, or impersonate another person or entity.
2. Prohibited conduct
You agree that you will not:
a. Attempt to gain unauthorized access to the Service, other users' accounts, or our underlying systems or infrastructure, or probe or test the vulnerability of that infrastructure without authorization;
b. Interfere with or disrupt the Service, including by overloading, flooding, or directing malicious traffic at it;
c. Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Service, except to the extent this restriction is not enforceable under applicable law;
d. Use automated means to scrape or harvest data from the Service, or to circumvent usage limits, rate limits, or access controls;
e. Resell, sublicense, or otherwise provide access to the Service to a third party, except as expressly permitted under your agreement with us; or
f. Use Output from the Service to develop or train a competing product or model, where we or an applicable third-party provider prohibit this.
3. Fair use of resources
The Service may be subject to usage limits on compute, generation volume, and storage, as described at the point of purchase or in your account settings. You must not attempt to circumvent these limits. We may throttle, suspend, or restrict usage that we reasonably determine to be excessive, abusive, or a threat to the stability or security of the Service. Repeated or deliberate circumvention of usage limits may also constitute a violation of Section 2 and is subject to the enforcement measures in Section 4.
4. Enforcement
Violations of this policy may result in a warning, content removal, throttling, suspension, or termination of your account, and, where appropriate, referral to law enforcement. We aim to take action proportionate to the severity and recurrence of the violation, though we reserve the right to act immediately in cases involving illegal content, harm to minors, or security threats. Refund & Cancellation Policy
5. Subscriptions
Subscriptions are billed in advance on a recurring basis. You may cancel at any time from your account settings. Cancellation stops future renewals and takes effect at the end of your current billing period; you retain access to paid features until that date. Except where required by applicable law, subscription fees already paid are non-refundable, and we do not provide partial refunds for unused time within a billing period.
6. Credits
Credits purchased for use of paid features are non-refundable once purchased, except as required by applicable law, and may expire as described at the point of purchase. Credits have no cash value and may not be transferred, sold, or redeemed for cash, except where required by applicable law.
7. Discretionary & statutory refunds
We may, at our discretion, issue a refund or credit — for example, in cases of duplicate charges, billing errors, or a sustained failure of the Service. Nothing in this policy limits any non-waivable refund, withdrawal, or cancellation right you may have under applicable law. Where such a right applies, it takes precedence over this policy to the extent of any conflict.
8. How to request a refund
To request a refund or report a billing issue, contact support@mixar.app within 14 days of the charge, including your account email and the relevant transaction details. Approved refunds are issued to the original payment method through our payment processor and may take several business days to appear, depending on your bank or card issuer.
9. Changes
We may update this policy from time to time. We will communicate material changes as described in our Terms of Service, and continued use of the Service after such changes take effect constitutes acceptance of the updated policy.
